摘要
水下文化遗产保护是一个世界性的难题。由于公海水下文化遗产保护的特殊性和复杂性,《联合国海洋法公约》及《水下文化遗产保护公约》难以解决其实际问题,有必要进一步落实和完善公海水下文化遗产保护的有关制度。中国作为一个存有大量海洋及水下文化遗产的国家应当积极加入有关公约,并在不断地完善国内保护水下文化遗产的立法的同时,借鉴有关国家的经验,积极保护本国散落在公海的水下文化遗产。
The protection of underwater cultural heritage is a worldwide problem.Due to the particularity and complexity of underwater cultural heritage protection in high seas,the United Nations Convention on the Law of the Sea and the Convention on the Protection of Underwater Cultural Heritage are difficult to solve the practical problems.It is necessary to further implement and improve the relevant system of high seas underwater cultural heritage protection.As a country with a large number of marine territory and underwater cultural heritage,China should actively join in the relevant conventions,and constantly improve the domestic legislation for the protection of underwater cultural heritage,learn from the experience of relevant countries,and actively protect the underwater cultural heritage scattered in the high seas.
