摘要
知识经济时代,企业识别与防范知识产权风险对其知识产权战略实施、减少风险实现的损失、发掘寓于风险之中的机遇具有重要且现实的意义。本文基于对知识产权风险的内生性、发展性和地域性的认识,从整体化风险识别与防范视角出发,从制度与技术维度,知识产权创造、运用、管理和保护维度,系统识别出企业知识产权风险因子共17种,并厘清这些风险因子之间的类型归属,提出该17种风险因子在引发风险事故时的逻辑关系要么是选择或并列关系,要么是因果关系,最后针对性的提出风险防范对策。
In the era of knowledge economy,it is of great and realistic significance for enterprises to identify and guard against intellectual property risk to implement their intellectual property strategy,reduce the loss of risk realization and explore the opportunities contained in risks.Based on the understanding of the endogenous,developmental and regional nature of intellectual property risk,this paper systematically identifies 17 risk factors of intellectual property rights in enterprises from the perspective of integrated risk identification and prevention,from the dimensions of system and technology,creation,application,management and protection of intellectual property rights,and clarifies the types and attributions of these risk factors,and puts forward that 17 risk factors are introduced.The logical relationship among the 17 risk factors in the risk accident is either a choice or a parallel relationship,or a causal relationship.Finally,the risk prevention countermeasures are put forward.
