摘要
普通法以英格兰古老的传统惯例为基底,诺曼征服后已逐渐见其滥觞,至亨利二世时期,普通法呈现出规范化、制度化和集中化的倾向。独居一隅的英格兰岛屿不但在社会、经济与政治发展道路上与欧洲大陆有所差别,在法律制度方面也走上一条不同于欧洲大陆普遍接受罗马法等制定法的道路,构成独具一格的法律体系,并将其受益范围扩大到整个盎格鲁圈。普通法具有浓厚的历史传统,其不断完善的过程成为英国能够较早孕育法治社会的重要前提,同时也作为坚实的制度基础为英国社会的领先发展保驾护航。
The common law is based on old traditional practice in England.After the Norman conquest,the common law began to appear gradually.At the time of Henry II,the common law showed a tendency of standardization,institutionalization and centralization.The island of England,which lives alone,is not only different from the continent in terms of social,economic and political development,but also in the legal system,which is different from the universal acceptance of Roman law and other laws-making in the European continent,forming a unique legal system and extending its benefits to the entire Anglo-British circle.The common law has a strong historical tradition,and its continuous improvement has become an important prerequisite for Britain to breed a society ruled by law earlier.At the same time,it also serves as a solid institutional basis for the leading development of British society.
