摘要
依据我国《民法总则》第一百二十一条,无因管理人有权请求本人偿还因管理事务而支出的必要费用,但法律并不承认管理人对此享有报酬请求权,造成无因管理人权利与义务明显不对等的现象。为平衡管理人与本人的权利义务关系,激励更多人去从事社会所期许的行为,应肯定无因管理人对管理事务享有报酬请求权的存在。依无因管理人是否提供了职业性质的管理服务的不同,可在报酬请求的数额上有所差异,但据此否定非职业人士无因管理的报酬请求权并不合理。
According to Article one hundred twenty one of the general principles of the civil law of China, the manager has the right to ask himself to repay the necessary expenses for the management affairs, but the law does not admit that the manager has the right to claim compensation, resulting in the phenomenon that the rights and obligations of the manager are obviously unequal. In order to balance the rights and obligations between the manager and himself, and encourage more people to engage in the behavior that the society expects, we should affirm the existence of the compensation claim right of the manager. The amount of compensation request may vary depending on whether the manager provides professional management services. However, it is not reasonable to deny the compensation claim of non-professionals’ non management.
