摘要
所有权系所有权人对于所有物,于法律限制的范围内,实施完整、全面、永久与整体支配(管领)的权利,系典型的物权或物权的原型,且为人民生活的基础。所有权在民法(私法)、公法、社会法乃至政治制度、经济制度中占据核心和关键地位,系一个国家的人民、社会与政府不可或缺的根本财产制度。所有权制度及其规则在全部民法典(尤其是物权编)居枢纽地位。我国编纂民法典物权编时,宜从所有权的含义与其权能的分隔,所有权的类型的统一,建筑物区分所有权的诸规则,相邻关系的新内容(形态),占有脱离物的善意取得,遗失物、埋藏物、漂流物、隐藏物与沉没物(品)的所有权归属及报酬请求,取得时效,无主物的先占以及附合、混合与加工等方面予以建构、厘定、丰富和完善。在我国处于新的历史起点的现今,经由厘定、建构、丰富、完善财产所有权制度及其规则来保障人民通过劳动而获得的财产,其含义深刻、隽永,实不可小觑。
Ownership means the owner implements a complete,comprehensive,permanent and overall control(governance)of the property within the limits of the law.It is a typical kind of the real right or the prototype of the real right,and a foundation of people’s life as well.Ownership occupies the core and key position in civil law(private law),public law,social law and even political system and economic system,so it is a fundamental property system indispensable to people,society and the government of a country.The ownership system and its rules enjoy a pivoting status in all Civil Codes especially the Real Right Section.When China codifies the Real Right Section of the Civil Code,the following aspects should be established,defined,enriched and improved:the separation between the meaning and functions of ownership,the unification of types of ownership,rules on condominium ownership,new content(form)of neighboring relations,bona fide acquisition towards property escaped from owner,the ownership of and claim for remuneration concerning lost objects,buried objects,drifting objects,hidden objects and sunken objects(items),positive prescription,preoccupation of ownerless articles,and adhesion,blending and processing and so on.Nowadays when China is at a new historical starting point,it is of profound and ever-lasting significance and cannot be underestimated to protect people’s properties gained from hard work through clarifying,establishing,enriching and improving property ownership system and its rules.
