摘要
城市管理执法者维护公共秩序与流动摊贩无序经营的矛盾是城市发展中常见的社会问题。前者执法的必要性与合法性,后者存在的合理性与违法性,以及消费者飘忽暧昧的社会态度,共同导致了流动摊贩治理困境。治理流动摊贩,既要求国家和政府完善立法与健全制度,形成全方位、多层次的法律体系,也要求具体执法者将依法行政与柔性执法巧妙融合,除此以外,还要寻求社会团体、摊贩自身以及所在社区的多元治理支持,从主体性视角出发来搭建政府与流动摊贩之间的沟通机制。积极构建以法治、德治、自治为核心的新型治理思路,处理好流动摊贩的非法性、维护好流动摊贩的服务性、发扬好流动摊贩的民生性,这是推进"以人为本"新型城镇化建设的应有之意。
The contradiction is a common social issure in urban development that the law enforcers of urban management keep the public order and the basic survival sought by mobile vendors They together led to the plight of mobile vendors governance,which includes the necessity and legality of law enforcement for the former,the rationality and illegality of the latter,and the ambiguous social attitude of consumers. The governance of mobile vendors requires the state and the government to perfect the legislation and improve the system to form an all-round and multi-level legal system.It also requires Specific executors will be the administration of law and flexible law enforcement skillfully integrated. But beyond that,it needs to seek multiple governance support from social organizations,vendors themselves and their communities,build up a communication mechanism between the government and mobile vendors from the perspective of subjectivity. It is necessary to actively construct a new governance idea with the core of rule of law,rule of virtue and autonomy,deal with the illegality of mobile vendors,maintain the service of mobile vendors, promote the livelihood of mobile vendors,which is to promote the new urbanization construction of" people-oriented".
