摘要
当前混合式教学对国际私法案例库的基本建构要素提出了新的要求与挑战,审视案例库建设当前所面临的案例资源碎片化明显、高质量案例匮乏、案例应用平台推进缓慢等问题,从学生的积极性不足、案例库体例的混乱、传统案例应用的僵化、案例开发的激励机制缺失来分析其影响因素,从而在混合性、针对性原则指引下,以国际私法“法律关系”为分类标准,以问题为导向,探究适合混合教学模式的纵向和横向交互的案例库模块设计,以更有效的创新国际私法案例库的建设路径。
The current blended teaching puts forward new requirements and challenges to the basic elements of the construction of a private international law case library.The problems currently faced by the construction of the case library are the obvious fragmentation of case resources,the lack of high-quality cases and the slow progress of case application platforms.From the analysis of the influencing factors such as the deficiency of student initiative,the confusion of case library system,the rigidity of traditional case applications and the lack of incentives for case development and based on the principles of miscibility and pertinence,and by taking the“legal relationship”of private international law as classification standard and the problems as orientation,the design of case library module suitable for the vertical and horizontal interaction of blended teaching model is explored so as to construct an efficient path for case library of private international law.
