摘要
违章建筑可作为执行标的虽无争议,但也不意味着违章建筑均可强制执行。按照违章建筑的违法程度进行分类,对违章建筑的不同情形作出不同处理。实践中强制执行青睐于拍卖的传统思维惯性,对违章建筑采取强制管理的措施也开始出现。在实施强制管理之前,须明确普通不动产强制管理在执行措施中的定位,在此基础上,确立拍卖先行,其后适用强制管理的原则。因违章建筑不能办理权属登记,建造人对其不享有所有权,但违章建筑事实上处于建造人的控制与管理之下,形成的是一种事实上的处分权。实施强制管理之后,通过监督管理人、赋予被执行人异议权、案外人异议等方式来平衡申请执行人、被执行人以及第三人的利益。
Illegal buildings can be used as the subject of enforcement although there is no dispute, but it does not mean that illegal buildings can be enforced. According to the degree of illegal building classification, different cases of illegal building treatment. In practice, the traditional thinking inertia favored auction, but mandatory management measures for illegal buildings also began to appear. Before the implementation of compulsory management, the positioning of ordinary real estate compulsory management in the implementation measures should be made clear. On this basis, the principle of auction first and then applying compulsory management should be established. Because the illegal construction cannot handle the ownership registration, the builder does not enjoy the ownership, but the illegal construction is actually under the control and management of the builder, which forms a kind of DE facto disposal right. After the implementation of compulsory management, the interests of the applicant for execution, the person subjected to execution and the third party shall be balanced by means of supervising the manager, entrusting the person subjected to execution with the right of objection, and the objection from an outsider.
