摘要
知识产权是创新驱动发展的制度载体。知识产权治理是知识产权法制体系和组织管理体制的统一,是中国国家治理体系和治理能力现代化的重要组成部分,必须站在国家治理的全局来理解和实施中国知识产权治理。改革开放四十年来,中国知识产权治理从私权自觉到创新自信,知识产权治理正当性愈加强化;从接轨国际到全球治理,知识产权治理格局日益扩大;从分散扩展到集约改革,知识产权治理体系不断优化。中国知识产权治理体系的建构和运作,实际上是知识产权法治逐渐确立、市场在创新资源配置中的决定性作用不断释放的过程。中国知识产权治理变革的基本路径与世界主流保持一致、同步发展,其根本宗旨是以法治手段推动中国的现代化转型。中国知识产权治理具有自身的优势、坚实的基础和强大的创新力,解决了中国自身创新发展的问题,沟通了中国与世界的经贸关系,拓展了发展中国家通过知识产权治理实施创新驱动发展的途径。
Intellectual property(IP) is the institutional carrier of Innovation-Driven Development Strategy. The IP Governance, including revolution of IP legal system and organization system, is an important part of modernization of Chinese national governance system and capabilities. Therefore, understanding and enforcement of Chinese IP Governance must be based on comprehensive consideration of national governance. Since the past forty years after the Reform and Opening-up, from awakening of privatization consciousness to self-confidence in innovation, the justification of IP Governance in China has been much more stronger;from decentralized expansion to intensive reform of organization system, the IP Governance system has been continuously optimized. The construction and operation of Chinese IP Governance system is a process in which Rule of Law in IP has been gradually established and the decisive role of market has been continuously functioning in the allocation of innovative resources. Therefore, the IP Governance reform of China is consistent with the mainstream of the world, and keeps paces with the world. Its basic principle is to promote modernization transformation in China by Rule of Law. Chinese IP Governance has its own advantages in solid foundation and strong innovation driving force. It solves Chinese native problems in innovation and development, promotes communication in economic and trade relations between China and the world, and expands the way for developing countries to accomplish Innovation-Driven Development through IP Governance.
