摘要
主办侦查员制度是一种岗位责任制,探索并建立主办侦查员制度,目的是要落实办案质量终身责任制,从而构筑起侦查办案与检察、审判有机统一、相互衔接的刑事司法责任体系。结合大连市刑侦部门的试行实践,从主办侦查员制度的含义、主办侦查员的责任、职权与职业保障、权力约束与制衡、资格条件及比例等级、遴选与培养等方面对主办侦查员制度相关问题作了有益探索。建立主办侦查员制度,究其实质,是用职业保障制度和办案质量终身责任制的正负激励机制,来促使侦查员不断提高侦查办案水平,增强诉讼意识,确保办案质量。
Investigator-in-charge system is a mechanism based on one’s responsibility,the aim of probing into and setting up the investigator-in-charge system is to implement the lifelong responsibility of case solving quality,thus building a criminal justice responsibility system for investigating and handling cases,procuratorial and trial organic integration and mutual connection.The article combines the experimental practice of the criminal investigation departments of Dalian,and makes the relevant issues of the investigator-in-charge system from the aspects of the nature,responsibility,authority and occupational security,power constraints and checks and balances,qualification conditions and proportions,selection and training of the investigator-in-charge system.The establishment of the system of investigator-in-charge is based on the positive and negative incentive mechanism of the occupational security system and the lifelong responsibility system for handling cases.The investigators are forced to improve the level of investigation and handling of cases,to enhance the awareness of litigation,and ensure the quality of case handling.
