摘要
我国管辖权异议制度目前存在的突出问题是实务操作的过度和理论研究的繁琐,究其根本原因在于对程序内在机理的忽视与疏离。在善意当事人和审判公正的一般立法假定下,我国管辖权异议的制度重构首先应当回归管辖权、异议权(行为)以及程序救济的基本原理和基本原则。在对管辖权异议的审判程序上,应当坚持法官对管辖事项的职权调查,强化被告提出异议的主张责任和程序的实质性参与,强化律师的诉讼责任;在对驳回管辖权异议裁定的救济上,改用被告向原审法院申请复议的方式。此外,还需兼顾与管辖相关制度的整合与衔接。
At present,the prominent problems existing in jurisdiction dispute system are the excessive practice and the tedious theoretical research.The root causes lie in that the internal mechanism of the procedure is neglected and alienated.Under the general legislative assumptions of bona fide parties and fair trial,the reconstruction of jurisdiction dispute system of China should first resort to the right of jurisdiction,right of dispute and the basic laws and principles of procedural relief.In terms of the trial procedure of jurisdiction dispute,judge’s rights of inspection of functions and powers on subject matter jurisdiction should be retained;the burden of asserting when the defendant raises objection and the substantive participation in the proceedings should be strengthened;and the litigation responsibility of the lawyer should be reinforced.In the remedy for rejection of jurisdiction dispute ruling,the procedure should be adopted where the defendant can appeal to the original court for reconsideration.Besides,the relevant jurisdiction administrative systems should also be integrated and combined.
