摘要
在当代国际社会,国际商事法院的建设日渐受到重视。新兴的国际商事法院呈现出组织架构专业化、机制灵活化、审判和管理信息化以及声誉国际化的特点。在中国,随着"一带一路"倡议的推进,最高人民法院正在筹建国际商事法庭,为当事人提供专业化的纠纷解决机制。建设中国国际商事法庭不仅需要有创新的制度设计,更要秉持先进的司法理念作为指引。从微观角度,中国建设国际商事法庭在法官的选任、审判语言、律师代理、协议管辖、集中管辖以及证据规则等方面存在不少困境和障碍。因此,需要在组织结构、律师代理、法官组成、管辖权、诉讼程序、判决承认与执行等相关制度领域,结合中国国情进行突破和创新,进而构建国际化、专业化、灵活化和信息化的国际商事法庭制度。从宏观而言,建设中国国际商事法庭,需要积极参与国际司法竞争,需要凸显司法服务的理念,需要合理拓展创新相关法律制度,也需要树立国际声誉和话语权。
In contemporary international society,the establishment of international commercial courts is becoming more and more popular.The newly establisl/ed international Commercial courts are characterized by the specialized framework and structure,flexible procedural mechanism,information,based trial and management system,as well as international fame.In China,with the development of "the Belt and Road"Initiative,the Supreme People's Court.of China.is preparing to establish an international commercial court,to provide business parties with a specialized dispute resolution mechanism.The establishment of the Chinese international commercial court not only requires innova- tive legal systems,but also heeds advanced judicial ideas as guidance.From the.micro perspective,to establish the international commercial court,China faces many challenges and obstacles,such as the selection .of judges,language in the trial,the system of the lawyer as agent,choice .of court,agreement,centralized jurisdiction and rules of evidence.Therefore,based on current circumstances and future developments,China should bring forth some new ideas and break through the above challenges and obstacles.From the macro perspective, to found the Chinese international commercial court,the court itself should actively participate in the international judicial competition,highlight the idea of access to justice,appropriately innovate legal systems and build up its international fame.
