摘要
证券市场治理结构是社会治理结构经济映像,是国家治理结构的缩影。社会治理结构的变革将推动国家治理能力和治理体系现代化改革进程的不断深入,国家与社会组织和市场主体间的治理权配置格局也将随之改变。我国证券市场治理模式正在历经现实层面的检视以及理论层面的批驳。权力配置错位引发了行政治理弱效性凸显、自律组织独立性丧失以及证券服务机构乱象频发等问题,证券市场治理结构改革已然成为了时代命题。厘定市场与政府之间的关系是重塑证券市场治理模式的前提,“放管服”改革为此提供了可行的改革进路,有利于构建起涵盖政府、行业自律组织以及市场主体的多元共治治理结构。
The securities market governance structure is the economic reflection of social governance structure and the epitome of national governance structure.The reform of social governance structure will promote the deepening of the modernization reform of national governance capacity and governance system,and the configuration of governance power among the state,social organizations and market entities will also change accordingly.China's securities market governance model is undergoing realistic examination and theoretical refutation.The dislocation of power allocation has led to such problems as highlighted weak efficiency of administrative governance,loss of independence of selfregulatory organizations and frequent chaos of securities service institutions.The reform of securities market governance structure has become an issue of The Times.To determine the relationship between the market and the government is the premise of reshaping the governance model of the securities market.The reform of"regulation regulation and service"provides a feasible approach to reform and is conducive to building a multi-governance structure covering the government,industry self-regulatory organizations and market subjects.
