摘要
我国现行的土地审批制度,是严格按照土地利用总体规划确定的用途使用土地。先行用地制度作为我国经济宏观调控的产物,是先批后占的一种例外行为,对保障国家重点基础设施建设用地需求、促进经济平稳健康发展发挥了重要作用。随着我国经济社会发展进入新常态,生态文明建设步入新阶段,用地需求发生了转变,土地资源保护面临着新要求。本文通过剖析先行用地制度的现状与问题,提出了新形势下进一步完善管理体制和机制的若干建议。
The current land examination and approval system in China,use of land strictly in accordance with the overall planning of land uses.The prior land utilization as a product of central macroeconomic regulation and control,to protect the land demand of national key construction projects、promote socio-economic stability and development、maintain the order of land management has played an important role.With China’s economic and social development entering a new normal,the construction of ecological civilization enters a new stage,land demand has changed,land resources protection faces new requirements.The paper analyzes the development status and problems of the prior land utilization and put forward some suggestions for further improving the management system and mechanism under the new situation.
