摘要
消费者安宁权是大数据背景下消费者安宁利益的权利外衣,其外延不断拓展且具有较强的易损性。我国尚无明确规定消费者安宁权的立法安排,相关司法实践呈现向"隐私权"规范逃离的现实困境。强化大数据背景下消费者安宁权的保护,应当加快保护消费者安宁权的立法,推动保护消费者安宁权的法规和行业规范的制定,明确消费者安宁权的保护范围和保护模式,建立侵害消费者安宁权的违法责任体系,合理设定消费者安宁权的边界。
Consumers’ peace right is the right cloak of consumers’ peace interest under the background of big data. Its extension is expanding and has strong vulnerability.There is no legislative arrangement that clearly stipulates the consumer’s right of tranquillity in China. Strengthening peace under the background of big data consumer rights protection, protecting the right of consumers peace should speed up legislation, to promote the protection of consumers right to peaceful formulation of laws and regulations and industry standard, specify the protection scope of the consumer right to peace and protected mode, establishing peace enroach on consumer rights law responsibility system, reasonable setting the boundary of the consumer right to peace.
