摘要
南北国家科技发展水平的严重不平衡使得技术转让政策的南北差异必然存在,从而导致知识产权争端。虽然中美之间某些领域技术水平对比的反转使中美技术转让政策立场发生某些对调,但总体而言,其仍然符合技术转让政策南北差异的一般规律。因此,中美技术转让政策争议乃至中美知识产权争端的发生是必然的;且在两国整体技术水平存在差距的现状下,对于争议的解决也只能是阶段性的,不可能一蹴而就。就当前阶段的中美知识产权争端而言,中国技术转让政策所具有的促进技术转让的附带效果不应当被认定为具有“强制性”。但是随着国家以及本国企业经济实力与创新能力的提升,以及发达国家对对等待遇的追求,中国技术转让政策背后蕴含的依赖外国技术转让以提升本国技术水平的思想基础可以有所调整。
There exists a North-South divide in technology transfer policy due to the imbalance of technological development between the two groups of countries,which often triggers disputes over intellectual property rights.Although there have been some changes to the equilibrium between China and the US owing to China s new technological developments in some fields,the disputes between China and the US over the intellectual property rights basically conforms to this South-North divide.Seen from this angel,it is not a surprise to see the ongoing China-US trade friction involving the issue of forced technology transfer.Given the gap between the two countries in technological development,any resolution to the disputes over intellectual property rights between the two countries would be temporary and short-term.Along with China s technological development and economic growth,the underlying logic of China s technology transfer policy would experience some changes in the future.
