摘要
自1979年元旦《告台湾同胞书》发表以来,中国共产党和政府运用法治方式处理台湾问题走过了四十年的历史实践。它可分为四个阶段:运用宪法形式确立对台大政方针(1979-1987);对台工作领域的法治探索与发展(1987-1997);对台工作逐步迈上法治化轨道(1997-2012);运用法治方式推进新时代两岸关系的全面发展(2012-)。实践表明,在对台工作中,要始终维护宪法在规范两岸关系中的权威地位,要始终坚持党的领导与全面依法治国相统一,要始终坚持涉台立法与实践发展需要相结合的探索道路,要充分重视在一个中国框架下推进两岸制度化协商。
Since the publication of the Letter to Compatriots in Taiwan on January 1, 1979, the CPC has used the rule of law to deal with the Taiwan Question for 40 years. It can be divided into four stages: Establish the Policy of “Peaceful Reunification and One Country, Two Systems” towards Taiwan in Constitutional forms (1979- 1987);Exploration and development of the rule of law in the field of work in Taiwan(1987-1997);The work on Taiwan was gradually put on the track of rule of law(1997-2012);The rule of law has been used to promote the comprehensive development of cross-Strait relations in the new era(2012 to date). Practice has shown that in our work on Taiwan, we must always uphold the authoritative position of the Constitution in regulating Cross-Straits relations, we must always adhere to the unity of the CPC’s leadership and the comprehensive rule of law, and we must always adhere to the exploration path of combining legislation related to Taiwan with practical development.We should attach great importance to promoting cross-Straits institutionalized consultation under the One-China framework.
