摘要
版权补偿金制度对于解决图书馆数字版权问题具有积极意义。但是,版权补偿金制度自身的弊端和对现代信息技术的不适应,使得这项制度规制图书馆传播利用数字作品又存在诸多问题,比如收费标准的欠精确、与版权技术保护措施的冲突、版权集体管理组织授权中介地位的边缘化等。创新版权补偿金制度的对策包括:构建相互并存和多元化的授权制度、开展科学的制度设计与安排、变革版权交易的中介制度和机制等。
It is true that copyright levy system is of positive significance in solving library digital copyright issues. However, due to the disadvantages of copyright levy system and its inadaptability to modern information technology, copyright levy system has problems in regulating library’s spreading and utilizing digital works, such as imprecise charging standard, conflict with copyright technology protection measures, and marginalization of the role of collective copyright management organizations(CMOs) as intermediaries. Innovative measures for copyright levy system include: building an authorization system of coexistence and diversity, developing scientific system design and arrangement, reforming intermediary system and mechanism in copyright transactions, etc.
