摘要
体育仲裁是国际体育领域解决体育纠纷的重要途径。运用文献资料等方法,对体育仲裁的受案范围进行论证。首先,对体育仲裁及体育仲裁权的来源进行了阐述。其次,对体育仲裁适用范围的内涵及条件进行分析和论证,认为:体育仲裁的适用条件主要是体育纠纷必须发生在竞技体育活动中或与竞技体育活动相关的事务中;体育纠纷应具有可仲裁性;体育纠纷当事人应具有处理体育纠纷案件的民事实体权利;体育纠纷当事人必须具有仲裁协议;强制适用体育仲裁解决的体育纠纷。最后,结合相关案例对体育仲裁受案范围的具体适用进行分析和论证。
Sports arbitration is an important way to solve sports dispute in international sports field.The use of literature,expert interviews,logical analysis and other methods,the sports arbitration scope is discussed.First of all,the source of sports arbitration and sports arbitration rights are described.Secondly,the connotation and the condition of the application scope of sports arbitration are analyzed and proved.That is:sports arbitration conditions include sports disputes must occur in sports activities or sports activities and related affairs;sports disputes should be arbitrated;sports dispute parties shall have the sports dispute cases of civil substantive rights;both parties must have sports dispute arbitration agreement;compulsory sports arbitration the sports dispute.Finally,the combination of relevant cases,analysis and demonstration of the application scope of sports arbitration.
