摘要
里约奥运会难民代表队的组建折射了国际奥委会执委会违反《奥林匹克宪章》的合法性议题,也遗留了奥运会参赛选手的国家身份认同危机。顾拜旦的体育地理学观念长期主导国际奥委会“体育国籍”的自治思想与制度安排,直至后者主动寻求与联合国的“政治国籍”保持相对一致性。为保障难民等群体的参赛权利、应对参赛身份的质疑、实现参赛政策的跨组织衔接,国际奥委会应适时适度修订运动员国籍条款,在确保国家奥委会正常运转的前提下,使难民运动员、独立参赛运动员、国籍转换运动员和跨国参赛队伍等合法性难题得到整体、妥善和彻底的解决。
The establishment of the Rio Olympic refugee team reflected the issue that the IOC Executive Committee violated the legitimacy of the Olympic Charter,also left over the crisis of national identity recognition of Olympic athletes.Coubertin’s sports geography view had dominated the “sports nationality” autonomy ideology and system arrangement of the International Olympic Committee over a long period of time,until the latter initiatively sought for maintaining relative consistency with the “political nationality” the United Nations.In order to ensure the game participation right of such groups as refugees,to deal with game participation identity questioning,and to realize the trans-organizational connection of game participation policies,the International Olympic Committee should revise athlete nationality clauses in a timely and appropriate fashion,so as to solve the issue of the legitimacy of refugee athletes,independent game participation athletes,nationality changed athletes and transnational game participation teams in an overall,proper and thorough way,under the precondition of ensuring the normal operation of the National Olympic Committee.
