摘要
对78个影响性刑事案件的实证考察发现,民意与司法紧张关系的背后是公众扩张权利、限制权力的诉求。样本案件及其发展表明,公民权利不断扩张,公权力行使逐步规范。影响性刑事案件折射出的社会问题,是对权利保护缺失,权力过于扩张。样本案件背后折射出的司法问题亦表明,当前司法在保障权利、约束权力方面存在缺失。以个案为依托,公众诉求强调身份对立来凸显社会矛盾,通过社会问题司法化来主张权利,对司法寄予了过多的、超出司法本身职能的期待。部分权利诉求虽然得到了司法层面的有力回应,并且推进了相关立法、制度的变革,但亦付出了惨痛的代价。应积极、主动应对权利诉求及其发展,推进司法改革以应对公众对司法的诉求,推进社会制度改革从根本上保障权利。公众的权利诉求应回归法治的轨道,背离法治的权利诉求,无论是对个体,还是对国家、社会,都是一种伤害。
An empirical study of 78 influential criminal cases shows that the relationship between public opinion and judicial tension lies in the demand for public expansion and restriction of power. The sample cases and its development show that citizens’ rights are expanding and the exercise of public power is gradually standardized. The social problem reflected by influential criminal cases is the lack of protection of rights and the excessive expansion of power. The judicial problems reflected in the sample cases also show that there are some deficiencies in the protection of rights and restraint of power in the current judicial system. On the basis of individual cases,the public demands to emphasize the conflict of identity highlight the social contradictions,to claim the right through the judicature of social issues,and places too much expectation on the administration of justice beyond the functions of the judicial itself. Look forward to the functions of the judiciary itself. Some rights claims have received strong responses from the judicial level,and promoted the relevant legislation,system changes,but also paid a painful price. We should actively and proactively respond to the demands of rights and its development,promote the judicial reform to respond to the public’s demand for justice,and promote the reform of the social system to guarantee the rights fundamentally. The right demand of the public should return to the track of rule of law,deviate from the right demand of rule of law,whether to the individual,or to the country,the society,is a kind of harm.
