摘要
难民保护是国际公法的重要内容之一,在人道救助和人权保护方面都有非常重要的意义。当前复杂的边境局势决定了我国面临着无法回避的难民权利保护问题,虽然我国在这方而作了大量工作,但至今没有相应的国内立法。制定专门法确定给予难民居留权的条件、设立详细的难民甄别规范、设置专门主管机关既有利于提高效率,也有利于保障申请难民地位人的基本权利。
Refugee protection is an important content in International law, which is of great significance to both humanity assistance and human rights protection. The problem of refugee protection cannot be avoided in the face of complex border situation. Although the Chinese government has done lots of work in this field, it still lacks relevant laws at home. It is vital to improve efficiency and guarantee the fundamental rights for the claimants by making special laws that ensure the right of residence for refugees, setting detailed standards to identify them, and establishing specific responsible authority.
