摘要
净化网络短视频传播环境,规范网络短视频市场,明确网络短视频平台的法律责任,须从违法行为、主观过错、损害事实及因果关系等四个要素分析。网络短视频平台侵权责任的认定,重点在于判定主观过错及适用免责条款。"避风港原则""红旗标准"是判断网络短视频平台主观过错的重要考量因素,平台是否承担了相应注意义务同样会影响侵权责任的判定。建议统一过错责任认定标准,明确平台注意义务,并完善"避风港原则"具体内容。
In order to purify the short video network environment, regulate its market, and clarify the legal responsibility of the short video network platform, we must start from four factors, including illegal behaviors, subjective faults, facts of damage and causality.In the identification of infringement of the short video platforms, the focus is on the identification of subjective faults and the applicable exception clauses.The "safe harbor rule" and "red flag standard" are important considerations for judging the subjective faults of the short video network platform.Similarly, whether the platform assumes its corresponding notice obligations will influence the judgement.It is recommended to unify the identification of subjective faults, clarify the platform's notice obligations, and improve the specific regulations of the "safe harbor rule".
