摘要
随着网络平台及其服务的发展，网络用户在使用平台服务过程中经常有意或无意地发生侵犯他人知识产权的问题，从而引发关于网络平台是否应当承担相应责任的问题。美国属于网络发达国家，在网络平台技术不断迭代发展的过程中，形成了一套值得借鉴的网络平台知识产权间接侵权责任规则。整体来说，在权利类型差异的基础上形成了协助侵权、替代侵权、引诱侵权三种间接侵权类型；从趋势上看，呈现逐渐强化网络平台责任，鼓励权利人、用户加强合作等。我国《侵权责任法》第36条第2、3款关于网络平台承担间接侵权责任的相关规定，在涉及知识产权侵权的具体问题时，有必要进一步地细化和完善。美国的经验富有启发性。
With the development of network platforms and their services, network users often intentionally or unintentionally infringe on the intellectual property rights of others during the use of platform services, which raises questions about whether the network platform should bear corresponding responsibilities. The United States is a developed country in network. In the process of continuous iterative development of network platform technology, a set of so - called network platform intellectual property indirect tort liability rules worthy of reference has been formed. Generally on the three types of indirect infringements, including contributory ducement of infringement, have been formed; and it will be ened the responsibility of platform operators, and encouraged basis of the difference in the types of rights, infringement, vicarious infringement and in- an inevitable trend to have gradually strengthrights holders and users to strengthen cooperation. The relevant provisions of article 36, paragraph 2 and paragraph 3 of the Tort Liability Law of China concerning the indirect tort liability of the network platform should be further refined and improved when it comes to the specific issues of intellectual property infringement. The American experience is instructive.
