摘要
近几年,中央和地方针对国家公园相继出台了一些方案和制度,在此基础上推进国家公园立法势在必行。国家公园立法必须坚持生态完整性、政府主导和多方参与、协调性发展等原则,着力构建权责分明的管理体制,实施公众参与机制与特许经营,充分体现环境法律制度的基本精神,建立和完善监管技术标准和监管体制。
In recent years the central and local government have respectively enacted some plans and systems with regard to national parks.Hence it is imperative to push on the legislation of national parks.It is a must to adhere to the protection of the originality and integrity of the ecosystem and the principles of government predominance and multiple participation and coordinated development for the legislation of national parks.The focus should be on the creation of management system of well-defined power and responsibility,the implementation of public participation mechanism and franchising,complete indication of the essential spirit of environmental law system,the establishment and improvement of the supervision of both technical standard and system.
