摘要
在加快建设海洋强国的政策推动下,中国海洋蓝色经济区发展加速。与此同时,海洋环境问题日益凸显,频发的一系列船舶撞击漏油、捕捞养殖污染等突发事件,导致海洋环境污染、生态破坏加剧,海洋经济的可持续发展离不开海洋生态本底的支撑和保障,相关问题已经引起了党和国家的高度关注。立足中国海洋环境司法现状,根据对相关司法案例数据进行量化分析发现,中国海洋生态环境损害司法救济方面存在法律配套机制不健全、司法鉴定工作开展不足、救济方式单一且预期效果差、生态损害赔偿主体范围小和执法部门权责不清等问题。对此,通过完善《中华人民共和国海洋环境保护法》等相关法律法规,建立完善的司法鉴定制度,扩大生态损害赔偿的主体范围,健全生态环境赔偿制度及加强执法部门信息公开和监管力度等对策,以期为解决国家海洋生态环境损害司法救济相关问题提供参考。
The policy of accelerating the maritime power building is accelerating the development of marine blue economic zones in China.Meanwhile,however,marine environmental problems happen frequently and are being increasingly highlighted.A series of frequent emergencies,such as ship collision,oil leakage and pollution caused by fishing and aquaculture,have aggravated marine environmental pollution and caused increasing ecological damages.Without the support and guarantee of a good marine ecological environment the sustainable development of marine economy would be impossible.A quantitative analysis of judicial data and cases related to marine environment according to the current judicial situation of marine environment in China shows that the main problems existing in the access to justice of the ecological damage to marine environment in China are inadequate legal supporting mechanisms,inadequate judicial identification,the single and poor access to justice,the small scope of proper compensators for marine ecological damage,and unclear responsibilities of law enforcement.It is necessary to improve the Marine Environmental Protection Law of the People's Republic of China and other relevant laws and regulations,establish a complete judicial identification system,expand the compensation scope of ecological damage,improve the ecological environment compensation system and strengthen the disclosure of information and the supervision of law enforcement.
