摘要
劳动基准是国家通过法律规范强制规定的劳动者的劳动条件和劳动待遇的最低标准。随着社会经济发展和科学技术的进步,以及构建和谐劳动关系的要求,我国对于劳动者的最低劳动条件和劳动待遇的保护也应逐步提高,但是现行劳动基准规范存在内容不够全面、规定不够具体、执行情况不佳等问题。本文通过分析制定劳动基准法的体例的各种选择,提出了我国完善劳动基准的途径。
The labor basic standards the minimum standard for labor conditions and labor treatment that are imposed by the state through legal norms.With the development of social economy and the advancement of science and technology,as well as the demand for the construction of harmonious labor relationsChina’s protection of workers’minimum labor conditions and labor treatment should be gradually improved.However,the existing labor benchmarks are not comprehensive enough.Problems such as insufficient comprehensive provisions,poor implementation,and so on.By analyzing the various choices of formulating the Labor Standard Law,this paper puts forward the ways to improve the Labor Standard Law in China.
