摘要
在劳动基准规范已比较丰富、劳动基准法理论已相对成熟的情况下,推动劳动基准立法对完善劳动基准体系具有重要意义。而劳动基准立法采取分散立法的模式还是统一立法的模式却有争议。从我国劳动基准立法的现状出发,不宜亦不易制定一部名为《劳动基准法》的法律,但是应该契合健全劳动标准体系的政策,一方面全面推行各领域、各行业的劳动基准立法,另一方面应以工资工时基准立法为抓手,尽快出台《工时法》、《工资法》。
It is of great significance to promote the labor standards legislation to improve the labor standards system under the condition of labor standards specification relatively abundant and the labor standards law theory relatively mature. However, it is controversial that the labor standard law should adopt the dispersive lawmaking mode or uniform legislation pattern. The article, starting from the present situation of our country's labor standard legislation, considers that it is unfavorable and not easy to enact a law named Labor Standard Law, but it should fit the policy of labor standard system. On the one hand, the comprehensive implementation of labor standard legislation in various areas and various industries is needed, on the other hand, it should first focus on the legislation of wages and labor-hour standard, and establish Labor-Hour Law and Wages Law as soon as possible.
