摘要
马克思主义发展观阐述了社会发展变化过程中的相互关联性和系统性,也为社会中法律制度发展提供了理论基础,法律应当以社会为基础,法律系统属于社会系统的组成部分,法律制度的发展受社会环境的制约。法律中的诉讼模式的发展进化过程,体现着马克思主义发展观的原理和规律,从传统纠问式诉讼到现代职权式诉讼的发展,从传统弹劾式诉讼到现代对抗式诉讼模式的发展,再到现代两种诉讼模式向混合式诉讼模式发展,都进一步印证了法律制度与法律系统、法律系统与社会系统、法律制度与社会环境之间的相互关系和作用,为法律制度改革指明了方向。
The Marxist concept of development expounds the interrelationship and systematic in the process of social development and change,and also provides a theoretical basis for the development of the legal system in society.The law should be based on society,and the legal system belongs to the social system.Development is constrained by the social environment.The development and evolution of litigation mode in law reflects the principles and laws of Marxist development concept,from the traditional questioning litigation to the development of modern power litigation,from the traditional impeachment litigation to the development of modern confrontation litigation mode.The development of the two modern litigation models to the hybrid litigation model further confirms the interrelationship and role between the legal system and the legal system,the legal system and the social system,the legal system and the social environment,and points out the direction for the reform of the legal system.
