摘要
2017年修订的《标准化法》确立了团体标准的法律地位,使团体标准成为我国的一种新标准。法律法规往往会援引标准,直至赋予标准以法律效力。欧盟《新方法》、世界贸易组织《贸易技术壁垒协议》和美国《国家技术转让与推动法案》中均规定了技术法规援引团体标准的方式,而我国尚未制定相关规则。我国法律法规采用一般援引的方式来援引政府主导制定的标准,这一方式不适用于援引市场主导制定的团体标准。国家鼓励实施团体标准,故而研究国外技术法规援引团体标准的规则,结合我国的标准体系,制定我国法律制度下援引团体标准的规则势在必行。
The "Standardization Law of the People’s Republic of China",revised in 2017,stipulates social organization standards as a new type of standards in China.Technical regulations sometimes adopt standards to solve problems,and then standards will have legal effect.The European Union’s "New Approach Directives",the United States’ "National Technology Transfer and Advancement Act",and the World Trade Organization’s"Agreement on Technical Barriers to Trade" all stipulate the way in which technical regulations adopt standards,while China has not yet enacted relevant rules.Chinese laws adopt government-led standards in a general way,which is not applicable to social organization standards formulated by the market-led.China encourages the implementations of social organization standards.Therefore,it is imperative to study the foreign regulations of adoptions and formulate the rules of adoption in the light of China’s standard system.
