摘要
长久以来,行政批示一直被归入内部行政行为而不具有行政诉讼的可诉性。但随着知识的更迭,人们对内部行政行为的认识由当然的不可诉转变成了基于外化因素,有条件地承认内部行政行为具有可诉性。这意味着在诸多行政批示中,一旦某个或某类批示具备了外化的条件,则有可诉的可能。因此,关于行政批示是否具有可诉性这一问题,不应当再以内部行政行为为借口,当然地认定行政批示不可诉,而应当综合考虑多方因素,且以行政批示是否对行政相对人的合法权益造成损害作为考虑可诉性问题的基本着眼点。
For a long time, administrative instructions have been classified as internal administrative behavior.As a rusult,people do not admit their justiciability in the field of administrative litigation. However, with the change of knowledge, people′s understanding of internal administrative behavior has changed from a unjustiable behavior to a litigable behavior when it has external factors, it will be conditionally recognized that internal administrative behaviors are litigable.This means that in many administrative instructions, once a certain or a certain type of instruction has external conditions, it is justifiable. Therefore, with regard to the issue of justiciability of administrative instruction, it should not take the internal administrative behavior as the excuse to determine that administrative instruction is unactionable, but consider various factors comprehensively, and take the damage of administrative instruction to the legitimate rights and interests of administrative counterparts as the basic focus to consider justiciability.
