摘要
自2015年《立法法》修订以来,设区的市对立法学人才的巨大需求同立法学学科发展现状、立法专门人才培养机制之间产生了巨大冲突。加之我国高校目前已设置立法学学科的数量较少、培养能力不足,更加剧了我国立法学学科建设与现实需求的矛盾。从立法学学科的兼容性、规范性特征来看,它可以依托法理学、宪法学,甚至政治学等学科的建设基础,推进立法学学科在各高校法学院(系)的设立。这一学科建设路径已经从国外一流大学立法学学科的建设上得到印证。在立法学学科设置上,我国高校法学院(系)应当强调立法理论与立法实务相结合的教学模式,重点开展立法学、立法方法论、部门法立法以及立法评估学的课程讲授活动。
Since the revision of the "Legislation Law" in 2015, there has been a huge conflict between the city’s huge demand for legislative talents and the current development of the legislative discipline and the training mechanism for legislative professionals. In addition, the small number of China’s colleges and universities that has set up legislative disciplines and the lack of training capacity have further aggravated the contradiction between the construction of legislative disciplines in China and the actual needs. Judging from the compatibility and normative characteristics of legislation discipline, it can promote the establishment of legislative disciplines in the colleges and universities based on the foundation of jurisprudence, constitutional law, and even political science. The path of this discipline establishment has been confirmed from the construction of the legislation disciplines in foreign universities. In the establishment of the legislation discipline, the colleges and universities of our country should emphasize the combination of legislative theory and legislative practice, focusing on the teaching of legislation, legislative methodology, departmental legislation and legislative evaluation.
