摘要
以《中国(上海)自由贸易试验区条例》为代表的上海自贸试验区地方立法,不仅生动演绎了重大改革于法有据与法治引领改革有机结合的实践,而且在发挥地方立法的实施性、主动性和创制性功能,协调国家事权与地方事权的平衡性方面做出了积极探索,甚至还在外资准入、证照分离、贸易便利化、金融服务、综合监管等方面进行了制度创新。该条例作为自由贸易试验区的"基本法",堪称上海地方立法史上最具有影响力的"第一法",成为自由贸易试验区可复制、可推广经验的重要载体,在地方立法史上具有重要的参考与借鉴价值。随着国内外形势的不断变化,条例部分内容已不适应自贸试验区的发展,有必要对其进行修订。
The local legislation of the Shanghai Pilot Free Trade Zone, represented by the "regulations of China(Shanghai) pilot free trade zone", vividly demonstrates the practice of organic combination of significant reform with law-based and rule-of-law-led reform. It also actively explores the implementation, initiative and creativity of local legislation, and coordinates the balance between national and local powers. In addition, it makes institutional innovations in foreign capital access, license separation, trade facilitation, financial services, and comprehensive supervision, etc. As the basic law of the free trade pilot area, the regulation can be regarded as one of the most influential laws in the history of Shanghai’s local legislation. It has become an important carrier of replicable and propagable experience with important reference value in the history of local legislation. With the changes of domestic and foreign situations, it is necessary to amend the regulations.
