摘要
我国法学本科教育的定位正从通识性向专业性、从知识性向技能性的方向变化,法律事务处理能力的培养正成为法学本科教育的主要追求目标。传统的实践教学模式导致在学生培养过程中存在学生部门法结合能力较差、写作能力严重弱化、专业数据库运用能力不足的缺陷。首先,明确培养法律争点的提炼能力、法律信息的检索能力、法律文书的写作能力是实践教学的基本目标。其次,应摒弃以观察者(案外人)视角下的"模拟"法庭,代之第一视角介入的对抗型实践教学方法。最后,在实践教学的内容优化方面,改良课程体系,均衡理论讲授与实践训练;优化师资结构,强化教师法律实践经验在教学中的角色与作用;强化法律技能训练,将法律运用技能作为实践教学的重点方面;调整毕业论文的考核测评体系,引入判例解析的考核方式。
The orientation of undergraduate legal education in China is transitioning from generalist-orientation to professional-orientation, from knowledge-orientation to skill-orientation. Practical skill has become the main teaching target of legal education. The traditional practical teaching mode leads to students ’ poor ability to integrate and apply departmental laws,students’ seriously weakened writing ability, and students ’ insufficient professional database retrieval ability. The author contends that first of all,it is the basic goal of practical teaching to cultivate the generalization and summarization ability of legal disputes, the retrieval ability of legal information,and the writing ability of legal documents. Secondly,the author suggests that the perspective of the observer(the outsider) in the moot court should be abandoned and replaced by the " confrontational" practice teaching method with the participants ’ first person ’ s perspective. Finally, a series of measures should be taken in teaching activities, such as, the content optimization of practical teaching, the improvement of the curriculum system,the balance between theoretical teaching and practical training, the optimizing the structure of teaching faculty, the strengthening the role of teachers’ legal practice experience in teaching activities, the strengthening of legal skills training, the the emphasis of legal skills in practice teaching as the essential aspects, the adjusting of the assessment system for graduation thesis, and the introduction of the assessment method of case analysis.
