摘要
文章对探矿权的实物形态、价值形态及其风险特点进行分析论证。探矿权的实物形态就是对查明的资源潜力或资源量的预期,依法对这个预期信息具有时限性的占用权;探矿权的价值是一种资本权益,不是作为自然资源的资产权益;探矿权的财产权具有非现金资产特性,变现难度大,适用于合资合作,特别是它具有很多不确定性,包括自然风险、流动性风险和环境风险。政府和市场主体,应充分了解和把握这些特性和特点以防止出现探矿权积压。
This paper analyzes and demonstrates the physical form,value form and risk characteristics of prospecting right.The physical form of the prospecting right is the expectation of the identified resource potential or resource quantity,it is the time-bound right to occupy this expected information according to law;the value of the prospecting right is a kind of capital interest,it is not a mineral resource right as a natural resource;the property right of the prospecting right has the characteristic of non-cash assets,which is difficult to realize,so it is suitable for joint venture cooperation,particularly it has many uncertainties,including natural risks,liquidity risks and environmental risks.Government and market players should fully understand and master these characteristics to prevent the backlog of prospecting right.
