摘要
经济补偿金作为一项重要的基础性制度,与失业保险制度、工会制度以及解雇保护制度有着密切关系,发挥着解雇保护、补充保障和补偿损失等功能。但我国经济补偿金也存在诱发矛盾和增加成本等弊端,所以改革迫在眉睫。文章通过比较域外主要国家经济补偿金及相关制度的规定,在结合我国国情的基础上,建议对失业保险制度和经济补偿金制度采取双向改革措施:一方面,扩大失业保险的适用范围和提高失业保险金的标准;另一方面,缩小经济补偿金的适用范围和降低经济补偿金的标准。
As an important fundamental system,economic compensation system,as an important fundamental system,is closely related to unemployment insurance system,trade unionism,and dismissal protection system and plays an important role for dismissal protection,supplement protection and compensation loss. However,there are many inadequacies in China’s economic compensation fund system. By comparing the related regulations abroad,as well as based on China’s national situation,it is suggested to adopt both-way reform measures:unemployment insurance system and economic compensation fund system. On the one hand,it is suggested to amplify the application range of the unemployment insurance and to improve the fund standard;on the other hand,it is suggested to decrease the application range of economic compensation fund and to lower the fund standard.
