摘要
《国有土地上房屋征收与补偿条例》仅有一个条文涉及国有土地上房屋征收范围制度。现行法存在征收范围确定主体不明、标的物范围不清、确定文书形式与相关文书送达规则缺失、征收范围确定后拘束力模糊且缺乏独立的救济程序等问题。法律供给的不足,导致了国有土地上房屋征收实践的诸多负面问题。从应然的角度看,国有土地上房屋征收范围的确定主体应为市县级人民政府,征收范围内征收标的物应包括房屋、土地使用权以及其他不动产。在征收实际操作过程中,对于房屋的内涵需要从多元视角来合理界定,认定其他不动产时需要结合具体的情况来进行分析。现行法规定的对国有土地上房屋征收应改为对国有土地上不动产征收。该征收范围确定文书应为"公告",法律应优化相关文书的送达方式,强化送达效果,明确并严格执行征收范围确定后对于被征收人、征收部门以及其他相关部门的拘束力。征收范围确定后应给予被征收人适当的救济。
There is only one article in the Regulations on the Expropriation of Houses on State-Owned Land and Compensation Therefor concerning the system of expropriation range of houses on State-owned land. In existing legislations, there are problems including that the subject determining the range of house expropriation is unclear, the range of subject matter is unclear, the legislation on the form of instrument and service is in short, the binding force of the determined range of house expropriation is uncertain, and there is no independent relief procedure. Due to deficiencies in the legislation, there are many negative issues in the practice of expropriation. From the perspective of what ought to be, the expropriation range of houses on state-owned land should be determined by the municipal and county-level people's governments. The subject matter should include houses, land use right and other real estate. In the course of expropriation, the connotation of house need be defined from a multi-dimensional perspective, and other real estate need be determined through analysis of specific circumstances. It is suggested that the expropriation of houses on state-owned land in current legislation should be amended as the expropriation of real estate on state-owned land. The instrument determining the expropriation range should be the Announcement. The legislation should improve the method of service, enhance the effect of service, make clear and strictly realize the binding force of the determined expropriation range over the expropriated person, the expropriation organ and other relevant organs. Appropriate relief should be granted to the expropriated person after the range of house expropriation is determined.
