摘要
人工智能作为当下最为前沿的技术类型,其多层化的基本技术架构决定了其复杂、多元的基本运行模式。在人工智能技术基础层、感知层、认知层和应用层四个层次中,基于不同层次的相关专利技术之间存在诸多的技术交叉与重叠,专利丛林、反公有地等专利市场运营风险频频发生。鉴于此,有必要分别从企业、产业、社会的现实需要出发,通过推行人工智能技术的合理化专利布局、联盟化专利管理、平台化专利交易等措施,化解人工智能技术专利运营中的争议与风险,实现对人工智能专利技术的充分保护与高效运营。
With the most cutting-edge technology types nowadays, artifi cial intelligence has a multivariate basic operation mode which is decided by its multiple technical framework. Due to the several technical crosses among the patents in different levels, patent market operation risks, such as patent thickets, anti-commonand so on, happen frequentlyin the four levelsof artifi cial intelligence technology including foundation level, perception level, cognition level and application level. Therefore, it is of vital necessity to solve disputes and risks in patents operation of artifi cial intelligence technologies to realize full protection and efficient operation of artificial intelligence patents by promoting patents layout rationally, establishing patent pools, and building patent transaction platforms based on realistic needs of enterprises, industry and society.
