因船舶买卖引起的船舶权属纠纷案件的裁判规则 被引量:4

摘要 近年来,海事法院审理了大量船舶权属纠纷案件,不少案件具有类型化、典型化的特点。船舶权属纠纷产生的原因较为复杂,因买卖引起的船舶权属变动最为常见。法官裁判案件时应从当事人、船舶、诉求请求的基本类型入手,准确界定案由,将船舶买卖合同的成立、生效、价款支付、交付、登记等环节作为考察法律关系变动的关键时点,进一步厘清审判思路、有的放矢,提高审判工作质效。同时,船舶的多重买卖、无权处分、善意取得、所有权保留买卖等问题亟待进一步统一裁判尺度,以提高当事人诉讼预期,规范市场交易行为,构建合法、诚信、安全、高效、便捷的交易秩序。 In recent years,maritime courts have heard a large number of cases concerning ownership of ships.Many cases have the characteristics of typification trend.The causes of disputes on ownership of ships are complex,of which the most common one is sale of ship.Judges should analyse the basic types of parties,ships and claims when deciding these cases.They should learn to accurately find out the cause of action.They need to focus on those elements such as formation,entry into force,payment,delivery and registration of contracts.Issues such as multiple sales of ships,unauthorized disposition,bona fide acquisition,retention of title need further study.Judges need to unify the criteria of adjudication to build a legitimate,honest,safe,efficient and convenient trade order.
