摘要
针对目前我国许多物流联盟并未真正实现合作共赢的现象,分析物流联盟产生机理、发展现状以及有盟无联、联而不盟的主要原因.依据制度经济学原理,定义物流联盟盟约并解析其涵义,指出物流联盟盟约的本质是契约,盟约具有契约性、公平性、纲领性、强约束性和可执行性的特点.提出组建紧密型物流联盟,按照明确物流联盟宗旨、设计物流联盟运营模式、规定盟员的权利与义务、不断完善细则来制定物流联盟盟约,并提出充分发挥各方作用、积极推动发展甩挂运输、加强诚信体系建设和物流市场监管保障物流联盟盟约顺利制定、执行.
In response to the problem of many logistics alliances being not a truly win-win cooperation in current China,the paper makes an effort to analyse the generation mechanism and current situation of logistics alliance so as to find out what caused the failure.Based on the principles of institutional economics,the treaty of logistics alliance is defined and its implications interpreted,and the essence of treaty of logistics alliance-contract-is pointed out.and treaty of logistics alliance is programmatic document characteristic of contractual nature,fairness,strong binding power and executability.It is suggested that compact logistics alliances be established;the operating mode be designed by clarifying the aims of logistic alliance;the rights and obligations of the members of logistics alliance be clearly prescribed;constant effort be made to perfect the specifications of logistic alliances construction.Furthermore,for the smooth formulation and implementation of treaty of logistics alliance,it is advocated that the full use of every party's force be mobilized;the transportation with dumping trailers be encouraged;the construction of credit system be reinforced and the supervision of logistics market be strengthened.
