摘要
中国投资"一带一路"沿线国家应当注意劳动法律风险。评估"一带一路"沿线国家的劳动法律风险,应考察"东道国劳动立法""劳动者群体维权行动"和"东道国法治水平"3个要素。"一带一路"沿线国家劳动法律风险表现各异,防控"一带一路"沿线国家中的劳动法律风险,可从宏观、中观、微观3个层面切入。宏观层面,可通过与沿线国家签订劳工合作协议、国际间工会合作的方式达成共识;中观层面,可通过完善国内立法、建立数字化的风险评估模型、为特定的风险类型购买保险等方式分散和转移风险;微观层面,可借由跨国企业采用生产守则、与工会主动谈判、劳动者和股权的本土化、采用灵活的用工制度等途径弱化冲突。
China should pay attention to legal risks of labour law when investing the countries along the Belt and Road.To evaluate the legal risks of labour law,we should consider three factors:“labor law of host country”,“the implementation of right of association”and“the legal standard of host country”.Legal risks of labour law vary from one country to another along the Belt and Road.We should prevent and control them from three aspects of macro level,medium level and micro level.At macro level,it can be achieved by means of signing international labor cooperation agreements with the countries along the Belt and Road and establishing cooperation among international labor unions;at medium level,we should improve domestic legal system and establish digital risk assessment models and buying insurance for specific risk types to disperse and transfer risk;at micro level,the conflict is cushioned by means of the adoption of production codes by multinational enterprises,active negotiation with trade unions,localization of workers and stock equity,and flexible employment system.
