摘要
沈家本虽力主推行独立行使审判权,但其基本态度由对精神的追求转为对制度的追求。沈家本在对独立行使审判权精神追求的过程中忽视了法治的基本要求,并因此遭到诟病。此后沈家本开始转向对于制度的追求,并推行包括审判机构的改革和制定程序法在内的一系列改革。其前后态度发生转变的原因在于逐渐意识到了规则重要性,这对于当今中国而言也同样具有重要价值。
Although Shen Jia-ben advocated the independent exercise of judicial power,his basic attitude changed from the pursuit of spirit to the pursuit of system.Shen Jia-ben ignored the basic requirements of the rule of law in the pursuit of the spirit of independent exercise of judicial power,and was criticized for this.Since then,Shen Jia-ben began to turn to the pursuit of the system,including the reform of the judicial organs and the enactment of procedural law.The reason for the change in attitudes was the gradual realization of the importance of rules,which is equally valuable to China today.
