摘要
"地方立法"这个词组包含两个单词,一是"立法",二是"地方"。关于"立法"的理论已经蔚为大观,关于"地方"的理论尚待培育。法律地理学作为法理学与地理学的交叉学科,旨在揭示法的地理属性、地方属性,旨在从根本上解释地方性的法。在学术思想史上,法律地理学已有可资借鉴的理论资源。见之于中国范围内的长城内外、大河上下,以及世界范围内的陆地和海洋,法律都因地理环境的差异而出现分野。从法律地理学的角度思考法的地方性,有助于把地方立法根植于特定的地理环境,更好地体现地方立法的地方性。
The phrase"local legislation"contains two words:one is"legislation"and the other is"local".The theory of"legislation"has been a great sight,while the theory of"local"needs to be cultivated.As an interdisciplinary subject of jurisprudence and geography,legal geography aims to reveal the geographical and local attributes of law and to explain thoroughly the local law.In the history of academic thought,legal geography has theoretical resources that can be used for reference.Seen within and outside the Great Wall of China,along the big rivers,as well as the land and seas in the world,laws are different because of the differences in geographical environments.Considering the locality of law from the perspective of legal geography helps to root local legislation in a specific geographical environment and better reflects the locality of local legislation.
