摘要
2016年《中国好声音》电视节目的商标、著作权和不正当竞争纠纷再次将电视节目模式的著作权保护推向了讨论焦点。电视节目模式包含了一档电视节目最具有特色的环节,其能否得到著作权的保护需要满足独创性、可复制性和属于具体的表达3项要求。但电视节目模式属于思想还是表达,学界和实务界目前尚未达成一致意见。笔者主张电视节目模式属于思想,不具有可版权性,其侵权判定中实质性近似的确定存在难度,不应受著作权保护,应采用其他合适的法律制度予以保护。
In 2016,the trademark,copyright and unfair competition disputes revolving“The Voice of China”have brought copyright protection of television formats to the focus of attention again.Television program formats contain the most characteristic part of a television program.Whether television formats can be protected under copyright depends on whether television formats are original,reproducible and expressive.Whether television formats are ideas or expressions is not reached in consensus among academia and practitioners.This article asserts that television formats are ideas so that copyrightability cannot apply.Further,it is difficult to determine copyright infringement about television formats.Therefore,television formats should not be protected under copyright,but should be protected under other appropriate legal mechanisms.
