摘要
当前南海局势趋缓降温,南海行为准则的磋商取得积极进展,这为中国-东盟开展南海务实合作提供了有利的条件。文章提出,基于南海地区的现实情况,中国-东盟应优先选择海洋环境保护领域进行合作。通过对波罗的海环境保护合作的几十年实践经验的剖析,文章提取了3个核心要素,作为中国-东盟框架下构建南海环保合作机制的基石。在当前落实《南海各方行为宣言》机制的发展势头良好、南海行为准则谈判进入深水区时,争取在准则范围内达成南海环境保护的法理框架,构建机制化的南海环境保护合作,有利于整合现有的海洋合作实践,为真正开启常态化、长效化和广泛性的区域海洋务实合作奠定基础。
The South China Sea region has seen some positive developments recently.In the past two years,parties to the SCS dispute have taken great efforts to manage differences while negotiation over a Code of Conduct is heading in the right direction.These developments create favorable conditions for promoting functional cooperation between China and ASEAN in the SCS.Among the many alternatives of maritime cooperation,China and ASEAN should prioritize marine environment protection considering its pro-cooperation advantages and the preliminary status of regional maritime cooperation.After investigating the four-decade experience of marine environment protection in the Baltic Sea,the paper proposes three core elements as the foundation for building a regional marine environment protection mechanism.Establishing a legal framework for marine environment protection and the related marine environment protection mechanism would help reinvigorate existing sporadic efforts of maritime cooperation in the region,thus paving the way for a long-term,institutionalized and overarching regime of marine cooperation in the SCS.
