摘要
侦查权的行使与公民个人权利息息相关,其运行方式与实现水平被视为实现社会公平正义和政治文明的风向标。在实践中,由于我国侦查权定位模糊,并且受限于国情因素,导致侦查权运行失序的问题较为严重。因此以价值目标、职能体系、实现路径、体制机制"四位一体"的范式对侦查权进行重构就成为突破侦查权运行瓶颈的关键。借助于侦查权的重构,并且通过侦查理念重塑、公安刑事司法化建设以及犯罪嫌疑人诉讼权利保障,可以为新时代侦查权与社会稳定的平衡拓展出一条新的路径。
The power of investigation,as closely linked to citizens’individual rights,can be seen as a sign of social fairness and justice as well as political civilization.In fact,the nature of China’s investigation right is vague,its operation is out of order,and national conditions are difficult to avoid are all issues we facing at present.The construction of the“four-in-one”dimensionality view of the right,as its value objective,function system,implementation path,and mechanism system,may be the key to China’s investigative power reconstruction.From a dual research perspective of investigation and politics studies,through analyzing the right unbalance causes may be helpful to reshape the investigation concept,construct public security criminal justice,and protect criminal suspects’litigation rights.
