摘要
作为高等职业院校总揽全局、掌控各方的总抓手,高等职业院校章程不仅仅承载着连接教育法律法规与院校内部规章制度的桥梁作用,更是高校内部治理的"基本法",是全面推进依法治校的关键。目前,我国大部分高等职业院校都制定了较为科学合理的高等职业院校章程,但碍于视野的局限,众章程难免存在不周延之处。以国内六所具有代表性的高等职业院校为样本,从其章程体例安排、实施机关、争议解决机制、程序机制、实施后果等角度入手,在比较、分析的基础上提出完善方案,以更大程度地彰显高等职业院校章程的法律属性,提升其法律效力,推进现代高等职业院校的制度建设。
As the higher vocational colleges,total control of the parties gripper commanding the whole situation,the articles of association of the vocational colleges not only bearing the connection bridge education laws and regulations and internal rules and regulations of colleges and universities,the university internal governance of“basic law”,is the key to comprehensively promote administration according to law.At present,most colleges and universities in our country have established the constitution of higher vocational colleges,which is more scientific and reasonable.However,due to the limitations of the vision,there are some inconsistencies in the articles of association.This paper attempts to domestic six representative sample of vocational colleges and from style arrangement,the implementation of organs,the dispute settlement mechanism,application mechanism,implementing consequences such as Angle,on the basis of comparative analysis of perfect scheme is put forward,to a greater degree of reveal the legal attribute of the articles of association of the vocational colleges,improve its legal effect,promote the establishment of a modern system of vocational colleges.
