摘要
文章分析了我国自然景观资源的产权及结构,各类景区及公园有偿使用的法规、有偿使用费的收取方式。自然景观资源产权及有偿使用存在的问题:(1)产权不明晰,所有者主体虚置;(2)有偿使用缺乏法律保障,整体利用权利体系缺位;(3)经营权出让形式多样,侵害国家所有者权益;(4)没有体现自然景观资源的生态价值。建议建立自然景观资源有偿使用制度,明确自然景观资源有偿使用范围与所有权具体代表,并以特许经营合同、设立自然景观资源地役权及设立自然景观资源使用权构建自然景观资源有偿使用权利体系。
This paper analyzes the property rights and structure of China's natural landscape resources,as well as the laws,regulations and the way to collect fees for compensated use of various types of scenic spots and parks.The problems of property rights and compensated use of natural landscape resources are:(1)The property rights are unclear and the ownership is empty;(2)There is no legal guarantee for compensation of the uses,and the overall rights system is absent;(3)Various forms of transfer of operating rights are infringed upon the state owner's rights;(4)The ecological value of natural landscape resources has not been embodied.It is recommended to establish a compensated use system of natural landscape resources,in addition,to specify the compensation scope and ownership of natural landscape resources.Meanwhile,there is a need to establish a compensated use right system of natural landscape resources concession contracts,the natural landscape resource access right and the establishment of natural landscape resource utilization(operating)right.
