摘要
共享经济创造性地拆分了资源的使用权和所有权,在共享经济的浪潮下在线短租行业获得蓬勃发展的机遇;但由于该领域法律法规尚不健全,短租行业在合规性和安全性等方面暴露出诸多问题。澳大利亚学者洛林·梅热罗尔提出的"第三方警务"理论,提倡调动社会多方力量齐抓共管,契合在线短租的治安管理需求。在立法规范行业市场准入的前提下开展在线短租行业管理,提出引入"第三方警务"理念,出台在线短租各级政府部门联合监管的规定,组建行业协会制定行业标准;同时发挥"互联网+"管理思路,将在线短租平台和房东纳为"第三方警务"的重要力量。
The sharing economy creatively separates the right to use from ownership of resources,which boosts online short-term rent industry.However,due to the lack of relative laws and regulations in this field,the short-term rent industry has been encountered with many problems in terms of compliance and security of transaction.The theory of“Third Party Policing”proposed by Lorraine Mazerolle,an Australian scholar,advocates the mobilization of multiparty forces in the society management.The method is in line with the demand of public security management for online short-term rent.On the premise of market access of legislation,the paper puts forward the concept of“Third Party Policing”,formulates the regulation of joint supervision by government departments at all levels,and sets up the associations to make industry standards.At the same time,the short-term rent network platforms and the landlord are the important forces of the“Third Party Policing”.
