摘要
警察执法道德困境不是警察在执法中对道德进行判断和认定的问题,而是对执法中多善取其一的情形左右为难的境况。道德困境来自于警务实践,其产生的原因包括执法执勤规范不够具体、工作负担沉重、媒体渲染与公众的不信任、部分领导干部缺乏担当和民警个人能力的不足等,这些困境最终也影响警务实践的具体成效。建议从强化执法权力、弥补规范漏洞;运用联动模式、明晰职责范围;完善执法保障、鼓励积极执法;加强社会信任、培养良好警民关系;以及强化警察职业能力和职业价值观等多方面破解困境。
The moral dilemma of police law enforcement is not a question of judgment and identification of morality in law enforcement,but a situation of dilemma in how to take one of the best.Moral dilemma comes from policing practice.The reasons for this include the lack of specific law enforcement rules,too heavy workloads,media negative guidance and public mistrust,as well as the lack of responsibility of some leaders,and the inadequate capacity of the police.Policing practice will be influenced by these dilemma eventually.It is suggested to solve the dilemma by strengthening the power of law enforcement and making up for the shortcoming in the law;using joint administration and clarifying the scope of responsibility;improving law enforcement guarantees and encouraging active actions;increasing social trust and fostering good police-civil relations;and reinforcing the police’s professional ability and professional values to solve the problems.
